These terms apply to your use of the dot clock app. By installing or using the app you agree to them. If you do not agree, do not use the app.
dot clock is a free interval timer that counts down work, rest and other phases of a workout and gives sound, voice and vibration cues. It is provided by Keuer Solutions Pty Ltd ("we", "us").
We grant you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own personal use, subject to these terms and the rules of the app store you got it from. You must not copy, modify, reverse engineer, sell, rent or redistribute the app, or remove any notices from it, except where the law allows.
The app is a timer. It does not provide medical, health or fitness advice, and it does not know anything about your health. The preset workouts are examples only. Before starting any exercise program, talk to a doctor or qualified professional, especially if you have a medical condition, are pregnant, are injured, or have not exercised for a while. Stop exercising and seek medical help if you feel pain, dizziness, shortness of breath or discomfort.
Exercise carries risk. You are responsible for choosing workouts, intensities and durations that are safe for you, for your form and technique, and for your surroundings and equipment. We are not responsible for injuries, health problems or damage that arise from exercising while using the app.
We work hard to make the timer accurate, but phones can pause apps, lower the volume, mute sounds or stop vibration depending on their settings, battery state and other apps. Do not rely on the app for anything where a missed or late cue could cause harm.
Workout names you type into the app stay on your device and belong to you. We do not receive them.
The app, its design, code, graphics, sounds and recorded voice cues are owned by Keuer Solutions Pty Ltd or our licensors and are protected by copyright and other laws. Nothing in these terms gives you ownership of any of it.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law or any other law that cannot be excluded.
Apart from the guarantees above, the app is provided "as is" and we make no other promises about it, including that it will be error-free, uninterrupted or suit your purposes. To the extent the law allows, we exclude all liability for any loss or damage, including indirect or consequential loss, arising from your use of or inability to use the app. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to supplying the app again or paying the cost of having it supplied again.
dot clock is free to download and use. The version described by these terms has no advertising and no in-app purchases. We may change that in future: we may add optional paid features, or include advertising, in a later version. If we do, we will say so in that version's release notes and, where it affects information handling, in an updated Privacy Policy and in the privacy details shown on the App Store and Google Play, before the version is released. Installing a later version is always your choice, and a version you already have does not change because a later one does.
We may update, change or discontinue the app or any feature at any time. Because the app is free, we have no obligation to keep providing it or to provide support, although we will try to help if you contact us.
You can stop using the app and delete it at any time. We may end your licence if you breach these terms. Sections 3, 4, 7, 8, 9 and 12 survive termination.
These terms are governed by the laws of Tasmania, Australia, and you submit to the non-exclusive jurisdiction of its courts. If any part of these terms is invalid, the rest still applies. These terms, together with the Privacy Policy, are the whole agreement between you and us about the app. Apple and Google are not parties to these terms and have no responsibility for the app, but Apple and its subsidiaries are third-party beneficiaries of these terms where the app is distributed through the App Store.
